Arbitration Agreement

This Arbitration Agreement ("Agreement") is part of the Lawn Rescue Co. LLC Terms and Conditions. It explains how disputes between you and Lawn Rescue Co. are resolved. Please read it carefully, as it affects your legal rights.

Informal resolution first

Most concerns can be resolved quickly. Before starting arbitration, you agree to contact us at info@lawnrescueco.com and give us a chance to resolve the issue for at least 30 days.

Agreement to arbitrate

If we cannot resolve a dispute informally, you and Lawn Rescue Co. agree that any dispute, claim, or controversy arising out of or relating to our services, website, or these terms will be resolved by binding arbitration rather than in court, except that either party may bring an individual claim in small claims court.

Arbitration rules and location

Arbitration will be administered under the Consumer Arbitration Rules of the American Arbitration Association (AAA) or a mutually agreed administrator. Arbitration will take place in Brunswick County, North Carolina, or another location we both agree to, and North Carolina law will apply.

Class action waiver

You and Lawn Rescue Co. agree that claims will be brought only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person’s claims.

Your right to opt out

You may opt out of this Arbitration Agreement within 30 days of first agreeing to it by emailing info@lawnrescueco.com with your name and a statement that you wish to opt out. Opting out will not affect any other part of the Terms.

Severability

If any part of this Agreement is found unenforceable, the rest will remain in effect, except that if the class action waiver is found unenforceable, this entire Arbitration Agreement will not apply to that dispute.
